Struggling with the Temporary Foreign Worker Program (TFWP) red tape? Canada’s new Recognized Employer Pilot (REP) might be your game-changer. This program, launched in September 2023, aims to simplify TFW hiring for employers who play by the rules and consistently fill in-demand jobs.

What is the Recognized Employer Pilot (REP)?

The REP is a pilot program launched in September 2023 to streamline the hiring process for Canadian employers who frequently use the TFWP and maintain high employment standards. It aims to benefit both employers and foreign workers by:

  • Simplifying the LMIA process: Recognized employers can obtain LMIA validity periods of up to 36 months for approved positions, compared to the standard 9 months. They may also be eligible for simplified LMIA applications when hiring additional workers in the future.
  • Providing faster access to labor: The streamlined process helps employers fill crucial positions more quickly, especially in sectors facing labor shortages.
  • Ensuring fair treatment of foreign workers: The REP upholds existing worker protections and ensures that wages, working conditions, and benefits meet Canadian standards.

Who is eligible for the REP?

To be eligible for the REP, employers must meet the following criteria:

  • Have a history of complying with TFWP requirements, with at least three positive LMIAs in the past five years for relevant occupations.
  • Demonstrate top-tier employment practices, including fair wages, safe working conditions, and access to benefits.
  • Be hiring for positions on the designated REP occupations list.

What are the REP occupations?

The REP occupations list is divided into two phases:

  • Phase 1 (launched September 2023): Primarily focused on positions in Primary Agriculture. You can find the specific occupations included on the official government website. https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/agri-food-pilot/about.html
  • Stage Two: Expands to other industries. As of February 2024, Stage Two is not yet fully implemented, but 84 new occupations were added to the REP list in December 2023, giving us a sneak peek at some likely inclusions. This list includes positions in various industries, such as:
    • Construction trades (e.g., carpenters, electricians, plumbers)
    • Food processing and manufacturing (e.g., bakers, butchers, millwrights)
    • Healthcare (e.g., nurses, personal support workers)
    • Transportation and logistics (e.g., truck drivers, warehouse workers)
    • Hospitality and tourism (e.g., cooks, chefs, servers)
    • Information technology (e.g., software developers, network administrators)
